1. Provider and scope

These terms apply to all purchases at Couch Clash, a service of spoboo GmbH, Kirchsteig 14, 78647 Trossingen, Germany (see the legal notice). They are aimed at consumers.

2. Service

Couch Clash is a party game show in the browser: one screen (e.g. the TV) shows the game, everyone plays on their own phone. We sell credit in euros on a code (like a prepaid card) – no user account needed (you can create one and keep your codes there):

• Every game uses credit per connected player and minute of active play, at the rate of its price tier. Currently: Standard games €0.79, Premium games and the whole party mode €0.99 per player-hour, kids' games free. From minute 91 of an evening only half the rate applies (the current discount is shown before every game).
• Lobby, breaks, radio, award ceremony, the trial, kids' games and additional screens cost nothing. Players disconnected for more than a minute don't count.
• The host decides who pays for whom (everyone in the living room, the remote players if they like); anyone not invited pays with their own code. Credit you add always goes on the buyer's code.
• When a code runs empty, the current question is played to the end; the resulting overdraft is settled with the next payment. You go on with a new code or with “Extend”: extension minutes are bought at half the rate (at least €2.99) and only count for this evening; any rest expires.
• Remaining credit stays on the code. Codes don't expire unless stated at purchase. Voucher codes (also printed ones) are transferable; anyone who knows the code can use the credit – keep it like cash.
• The free trial game is a complete game of about 30 minutes with the categories that have no running AI costs and the finale, for up to 4 players, and can be used once per device.

You need an up-to-date browser and an internet connection. AI-powered content (host, judging, avatars) may be simplified at times of high demand; the game itself stays playable.

2a. Changes to the rates

Die Verbrauchssätze pro Spielerstunde können geändert werden. Es gilt immer der Satz, der vor Spielstart angezeigt wird. Bereits gekauftes Guthaben bleibt in Euro erhalten.

We announce increases at least 28 days ahead – on the website, in the game before the start and by e-mail to account holders. Credit bought before an increase is still used at the old rate. Decreases apply at once. If you object to an increase, we refund your remaining credit through support on request.

3. Conclusion of the contract

The presentation of the products is not a binding offer. By clicking “order with obligation to pay” or “Pay” at checkout you make a binding offer; the contract is concluded with the successful payment. You receive the confirmation by e-mail.

3a. Gift set by post

When „Geschenkset zusenden“ is offered, you can order credit and the Christmas box as a printed gift set as well. The surcharge for printing and shipping shown in the shop is added. We deliver to Germany, Austria and Switzerland and ship within 3 working days of the order. The codes are valid until 31 December of the third year after the order (the date is on the label on the card); to Austria without an expiry date. The code is only on the card and is activated when the item is shipped. The statutory 14-day right of withdrawal from receipt applies to the gift set; the consent to start right away (section 5) only concerns credit to print yourself.

4. Prices and payment

All prices are final prices including 19% VAT – the checkout charges exactly the price shown in the shop. Where no German VAT is due – for businesses with a valid VAT ID from another EU country (reverse charge) and for customers outside the EU, e.g. in Switzerland – the invoice shows no German VAT. Payment is processed by the payment service provider Stripe (card, Apple Pay, Google Pay, PayPal and other payment methods shown). The amount is due immediately. Every purchase comes with an invoice to download, and a credit note if it is refunded.

5. Right of withdrawal

Consumers have a right of withdrawal according to the following instructions. Credit is a digital service. Before every purchase you expressly confirm: “I expressly request that Couch Clash starts providing the service immediately – before the withdrawal period ends. I understand that I lose my right of withdrawal once the contract has been fully performed, and that if I withdraw earlier I pay for the part already used.”

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (spoboo GmbH, Kirchsteig 14, 78647 Trossingen, Germany, e-mail: info@spoboo.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. an e-mail). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Early expiry of the right of withdrawal

The right of withdrawal expires once we have fully performed the service and began the performance only after you gave your express consent and at the same time acknowledged that you lose your right of withdrawal once we have fully performed the contract.

6. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of slight negligence we are only liable for breaches of essential contractual obligations, limited to the damage typical for the contract and foreseeable.

7. Final provisions

German law applies; mandatory consumer protection provisions of your country of residence remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
